This is not a deal that investors would have accepted had Perpetual ever put it to them. Since Lehman defaulted over 2.5 years ago Perpetual have never ever held a bond holder meeting or consulted with bond holders despite numerous and formal requests - they even chose to inform investors of the result by releasing the information to the press first. This is a Trustee who has blindly stumbled into litigation and spent the last two years trying to get out of it with a focus on themselves rather than the investors they are supposed to represent.
