ISDA should consider whether a credit event actually occurred when a company still has access to the credit markets. The idea of a Restructuring credit event was a company in distress that may well become insolvent restructures its debt in a way that's materially disadvantageous to the affected creditors. Not sure Cemx's "Restructuring" met that standard.
