Clarification: the print version of this article says (paragraph six) that the court ruled in Ferguson’s favour in May 2013. To clarify, this ruling was against Octagon’s motion to dismiss the case. In other words, the court ruled that Ferguson’s claim should proceed and should not be summarily dismissed, as the article now makes clear. It was not a filing ruling on the merits of the claim. In addition, MVC Capital is the second largest (and only other) outside shareholder in Octagon after CCMP. Members of Octagon management own most of the 49% that is not owned by CCMP.
