Yes, I agree this is a terrible conflict situation for CDS. I don't see a solution. Are there any proposals on the table? Not just for this particular event but for all similar and imaginable situations in which a borrower - or the lenders to that borrower - can determine the timing of a Credit Event and whether to "create" that Credit Event.
